       Commissioner Schifino moved the following:
       
    1         CRC Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         
    6         SECTION 8. Eligibility.—
    7         No person shall be eligible for office of justice or judge
    8  of any court unless the person is an elector of the state and
    9  resides in the territorial jurisdiction of the court. No justice
   10  or judge shall serve after attaining the age of seventy years
   11  except upon temporary assignment or to complete a term, one-half
   12  of which has been served. No person is eligible for the office
   13  of justice of the supreme court or judge of a district court of
   14  appeal unless the person is, and has been for the preceding ten
   15  years, a member of the bar of Florida. No person is eligible for
   16  the office of circuit judge and shall not preside on the circuit
   17  bench in any capacity, unless the person is, and has been for
   18  the preceding five ten years, a member of a bar of one of the
   19  states or territories of the United States of America, of which
   20  the last five years were as a member of the bar of Florida.
   21  Unless otherwise provided by general law, no No person is
   22  eligible for the office of county court judge unless the person
   23  is, and has been for the preceding five years, a member of the
   24  bar of Florida. Unless otherwise provided by general law, a
   25  person shall be eligible for election or appointment to the
   26  office of county court judge in a county having a population of
   27  40,000 or less if the person is a member in good standing of the
   28  bar of Florida.

   30         A new section is added to Article XII of the State
   31  Constitution to read:
   32                             ARTICLE XII                           
   33                              SCHEDULE                             
   34         Qualifications of circuit judges and county court judges.—
   35  The amendment to Section 8 of Article V, which revises the
   36  qualifications for a person to be eligible for the office of
   37  circuit judge, shall only apply prospectively from January 8,
   38  2019. The amendment may not be construed to affect a person who
   39  has assumed the office of circuit judge on or before January 8,
   40  2019, or any person who has been nominated for a vacancy in the
   41  office of circuit judge by a judicial nominating commission, but
   42  has not yet assumed office, as of January 8, 2019.

   48                         A proposal to amend                       
   49         Section 8 of Article V of the State Constitution to
   50         create a new section in to Article XII of the State
   51         Constitution to require a person to have at least ten
   52         years membership in a bar in the United States of
   53         America, the preceding five of which must be in The
   54         Florida Bar, in order to be eligible to serve in the
   55         office of circuit judge or preside on the circuit
   56         bench.
