    6         A proposed revision relating to the removal of
    7         discriminatory and obsolete provisions; amending
    8         Section 2 of Article I of the State Constitution to
    9         remove a provision authorizing laws that regulate or
   10         prohibit the ownership, inheritance, disposition, and
   11         possession of real property by aliens ineligible for
   12         citizenship; amending Section 9 of Article X of the
   13         State Constitution to remove prohibition on the
   14         retroactive application of changes in criminal laws to
   15         the punishment of previously committed crimes; and
   16         amending Section 19 of Article X of the State
   17         Constitution to delete an obsolete provision regarding
   18         the development of a high speed ground transportation
   19         system.

   21  Be It Proposed by the Constitution Revision Commission of
   22  Florida:
   23  
   24         Section 2 of Article I of the State Constitution is amended
   25  to read:
   26                              ARTICLE I                            
   27                        DECLARATION OF RIGHTS                      
   28         SECTION 2. Basic rights.—All natural persons, female and
   29  male alike, are equal before the law and have inalienable
   30  rights, among which are the right to enjoy and defend life and
   31  liberty, to pursue happiness, to be rewarded for industry, and
   32  to acquire, possess and protect property; except that the
   33  ownership, inheritance, disposition and possession of real
   34  property by aliens ineligible for citizenship may be regulated
   35  or prohibited by law. No person shall be deprived of any right
   36  because of race, religion, national origin, or physical
   37  disability.

   39         Sections 9 and 19 of Article X of the State Constitution
   40  are amended to read:
   41                              ARTICLE X                            
   42                            MISCELLANEOUS                          
   43         SECTION 9. Repeal of criminal statutes.—Repeal or amendment
   44  of a criminal statute shall not affect prosecution or punishment
   45  for any crime previously committed before such repeal.
   46         SECTION 19. Repealed High speed ground transportation
   47  system.—To reduce traffic congestion and provide alternatives to
   48  the traveling public, it is hereby declared to be in the public
   49  interest that a high speed ground transportation system
   50  consisting of a monorail, fixed guideway or magnetic levitation
   51  system, capable of speeds in excess of 120 miles per hour, be
   52  developed and operated in the State of Florida to provide high
   53  speed ground transportation by innovative, efficient and
   54  effective technologies consisting of dedicated rails or
   55  guideways separated from motor vehicular traffic that will link
   56  the five largest urban areas of the State as determined by the
   57  Legislature and provide for access to existing air and ground
   58  transportation facilities and services. The Legislature, the
   59  Cabinet and the Governor are hereby directed to proceed with the
   60  development of such a system by the State and/or by a private
   61  entity pursuant to state approval and authorization, including
   62  the acquisition of right-of-way, the financing of design and
   63  construction of the system, and the operation of the system, as
   64  provided by specific appropriation and by law, with construction
   65  to begin on or before November 1, 2003.

   67  BE IT FURTHER PROPOSED that the following statement be placed on
   68  the ballot:

   73         PROPERTY RIGHTS; REMOVAL OF OBSOLETE PROVISION; CRIMINAL
   74  STATUTES.—Removes discriminatory language related to real
   75  property rights. Removes obsolete language repealed by voters.
   76  Deletes provision that amendment of a criminal statute will not
   77  affect prosecution or penalties for a crime committed before the
   78  amendment; retains current provision allowing prosecution of a
   79  crime committed before the repeal of a criminal statute.
