Commissioner Martinez moved the following:
1 CRC Amendment (with title amendment)

3 Delete everything after the proposing clause
4 and insert:
5 Sections 2 and 3 of Article I of the State Constitution are
6 amended to read:
7 ARTICLE I
8 DECLARATION OF RIGHTS
9 SECTION 2. Basic rights.—
10 All natural persons, female and male alike, are equal
11 before the law and have inalienable rights, among which are the
12 right to enjoy and defend life and liberty, to pursue happiness,
13 to be rewarded for industry, and to acquire, possess and protect
14 property; except that the ownership, inheritance, disposition
15 and possession of real property by aliens ineligible for
16 citizenship may be regulated or prohibited by law. No person
17 shall be deprived of any right because of race, religion,
18 national origin, or physical disability.
19 SECTION 3. Religious freedom.—
20 There shall be no law respecting the establishment of
21 religion or prohibiting or penalizing the free exercise thereof.
22 Religious freedom shall not justify practices inconsistent with
23 public morals, peace or safety. No revenue of the state or any
24 political subdivision or agency thereof shall ever be taken from
25 the public treasury directly or indirectly in aid of any church,
26 sect, or religious denomination or in aid of any sectarian
27 institution.

30 And the title is amended as follows:
31 Delete everything before the proposing clause
32 and insert:
33 A proposal to amend
34 Sections 2 and 3 of Article I of the State
35 Constitution to remove a provision authorizing laws
36 that regulate or prohibit the ownership, inheritance,
37 disposition, and possession of real property by aliens
38 ineligible for citizenship and to remove the
39 prohibition against using public revenues in aid of
40 any church, sect, or religious denomination or any
41 sectarian institution.
