CRC - 2017 P 35 By Commissioner Stemberger stembergj-00010-17 201735__ 1 A proposal to amend 2 Section 8 of Article V and create a new section in 3 Article XII of the State Constitution to increase the 4 age after which a justice or judge may no longer serve 5 in a judicial office on or after a specified date. 6 7 Be It Proposed by the Constitution Revision Commission of 8 Florida: 9 10 Section 8 of Article V of the State Constitution is 11 amended, and a new section is added to Article XII, to read: 12 ARTICLE V 13 JUDICIARY 14 SECTION 8. Eligibility.—No person shall be eligible for 15 office of justice or judge of any court unless the person is an 16 elector of the state and resides in the territorial jurisdiction 17 of the court. No justice or judge shall serve after attaining 18 the age of seventy-fiveseventyyears except upon temporary 19 assignment or to complete a term, one-half of which has been 20 served. No person is eligible for the office of justice of the 21 supreme court or judge of a district court of appeal unless the 22 person is, and has been for the preceding ten years, a member of 23 the bar of Florida. No person is eligible for the office of 24 circuit judge unless the person is, and has been for the 25 preceding five years, a member of the bar of Florida. Unless 26 otherwise provided by general law, no person is eligible for the 27 office of county court judge unless the person is, and has been 28 for the preceding five years, a member of the bar of Florida. 29 Unless otherwise provided by general law, a person shall be 30 eligible for election or appointment to the office of county 31 court judge in a county having a population of 40,000 or less if 32 the person is a member in good standing of the bar of Florida. 33 ARTICLE XII 34 SCHEDULE 35 Eligibility of justices and judges.—The amendment to 36 Section 8 of Article V increasing the age at which a justice or 37 judge is no longer eligible to serve in judicial office, except 38 upon temporary assignment or to complete a term, shall take 39 effect July 1, 2019.
