Floor: 1/AD . 03/21/2018 05:36 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Commissioners Johnson and Washington moved the following: 1 CRC Amendment (with title amendment) 2 3 Delete everything after the proposal clause 4 and insert: 5 Section 4 of Article IX of the State Constitution is 6 amended to read: 7 ARTICLE IX 8 EDUCATION 9 SECTION 4. School districts; school boards; innovation 10 school districts.- 11 12 (a) Each county shall constitute a school district; 13 provided, two or more contiguous counties, upon vote of the 14 electors of each county pursuant to law, may be combined into 15 one school district. In each school district there shall be a 16 school board composed of five or more members chosen by vote of 17 the electors in a nonpartisan election for appropriately 18 staggered terms of four years, as provided by law. 19 (b) The school board shall operate, control and supervise 20 all free public schools within the school district and determine 21 the rate of school district taxes within the limits prescribed 22 herein. Two or more school districts may operate and finance 23 joint educational programs. 24 (c) The legislature shall provide by law the process by 25 which a school district can qualify for the designation of 26 innovation school district. The district school board may, by 27 majority vote of the board, seek the innovation school district 28 designation. The school board shall continue to operate, 29 control, and supervise all free public schools within the 30 innovation school district and the school board shall remain the 31 governing board of the innovation school district with the 32 district school superintendent as the chief executive officer. 33 In order to promote diverse and innovative educational 34 opportunities for all of Florida’s students, school districts 35 seeking innovation district status shall be eligible for 36 exemption from all provisions of the Florida law in the same 37 manner as other public schools designated by Florida law. The 38 district school board shall indicate which of these exemptions 39 it seeks to obtain. 40 (d) The legislature shall enact legislation implementing 41 subsection (c) of this section, effective no later than July 1, 42 2019. 43 44 ================= T I T L E A M E N D M E N T ================ 45 And the title is amended as follows: 46 Delete everything before the proposal clause 47 and insert: 48 A proposal to amend 49 Section 4 of Article IX of the State Constitution to 50 authorize high-performing school districts to become 51 innovation school districts exempt from certain 52 provisions of law applicable to school districts and 53 requiring the legislature to implement by July 1, 54 2019.
