    4         A proposal to amend Section 2 of Article I of the
    5         State Constitution to remove a provision authorizing
    6         laws that regulate or prohibit the ownership,
    7         inheritance, disposition, and possession of real
    8         property by aliens ineligible for citizenship; amend
    9         Section 9 of Article X of the State Constitution to
   10         provide that the repeal of a criminal statute shall
   11         not affect the prosecution of any crime committed
   12         before such repeal; and amend Section 19 of Article X
   13         of the State Constitution to delete an obsolete
   14         provision regarding the development of a high speed
   15         ground transportation system.

   17  Be It Proposed by the Constitution Revision Commission of
   18  Florida:
   19  
   20         Section 2 of Article I of the State Constitution is amended
   21  to read:
   22                              ARTICLE I                            
   23                        DECLARATION OF RIGHTS                      
   24         SECTION 2. Basic rights.—All natural persons, female and
   25  male alike, are equal before the law and have inalienable
   26  rights, among which are the right to enjoy and defend life and
   27  liberty, to pursue happiness, to be rewarded for industry, and
   28  to acquire, possess and protect property; except that the
   29  ownership, inheritance, disposition and possession of real
   30  property by aliens ineligible for citizenship may be regulated
   31  or prohibited by law. No person shall be deprived of any right
   32  because of race, religion, national origin, or physical
   33  disability.

   35         Sections 9 and 19 of Article X of the State Constitution
   36  are amended to read:
   37                              ARTICLE X                            
   38                            MISCELLANEOUS                          
   39         SECTION 9. Repeal of criminal statutes.—Repeal or amendment
   40  of a criminal statute shall not affect prosecution or punishment
   41  for any crime previously committed before such repeal.
   42         SECTION 19. Repealed High speed ground transportation
   43  system.—To reduce traffic congestion and provide alternatives to
   44  the traveling public, it is hereby declared to be in the public
   45  interest that a high speed ground transportation system
   46  consisting of a monorail, fixed guideway or magnetic levitation
   47  system, capable of speeds in excess of 120 miles per hour, be
   48  developed and operated in the State of Florida to provide high
   49  speed ground transportation by innovative, efficient and
   50  effective technologies consisting of dedicated rails or
   51  guideways separated from motor vehicular traffic that will link
   52  the five largest urban areas of the State as determined by the
   53  Legislature and provide for access to existing air and ground
   54  transportation facilities and services. The Legislature, the
   55  Cabinet and the Governor are hereby directed to proceed with the
   56  development of such a system by the State and/or by a private
   57  entity pursuant to state approval and authorization, including
   58  the acquisition of right-of-way, the financing of design and
   59  construction of the system, and the operation of the system, as
   60  provided by specific appropriation and by law, with construction
   61  to begin on or before November 1, 2003.

   63  BE IT FURTHER PROPOSED that the following statement be placed on
   64  the ballot:

   69         PROPERTY RIGHTS; REMOVAL OF OBSOLETE PROVISION; CRIMINAL
   70  STATUTES.—Removes discriminatory language related to real
   71  property rights. Removes obsolete language repealed by voters.
   72  Deletes provision that amendment of a criminal statute will not
   73  affect prosecution or penalties for a crime committed before the
   74  amendment; retains current provision allowing prosecution of a
   75  crime committed before the repeal of a criminal statute.
