       Commissioner Plymale moved the following:
       
    1         CRC Amendment (with ballot and title amendments)

    4  insert:
    5         Section 5 of Article VI of the State Constitution is
    6  amended to read:
    7                             ARTICLE VI                            
    8                       SUFFRAGE AND ELECTIONS                      
    9         SECTION 5. Primary, general, and special elections.—
   10         (a) A general election shall be held in each county on the
   11  first Tuesday after the first Monday in November of each even
   12  numbered year to choose a successor to each elective state and
   13  county officer whose term will expire before the next general
   14  election and, except as provided herein, to fill each vacancy in
   15  elective office for the unexpired portion of the term. A general
   16  election may be suspended or delayed due to a state of emergency
   17  or impending emergency pursuant to general law. Special
   18  elections and referenda shall be held as provided by law.
   19         (b) If all candidates for an office have the same party
   20  affiliation and the winner will have either no opposition in the
   21  general election, or opposition only from one or more write-in
   22  candidates, then all qualified electors, regardless of party
   23  affiliation, may vote in the primary elections for that office.

   33                      ARTICLE XII, NEW SECTION                     
   34         LOBBYING AND ABUSE OF OFFICE BY PUBLIC OFFICERS; PRIMARY
   35  ELECTIONS.—The amendment expands restrictions on lobbying for
   36  compensation by former public officers; creates restrictions on
   37  lobbying for compensation by currently serving public officers;
   38  provides exceptions; prohibits certain abuses of public office
   39  for personal benefit. The amendment also provides that all
   40  voters, regardless of party affiliation, may vote in a partisan
   41  primary election if winner of the primary election will face no
   42  opposition or only opposition from a write-in candidate in the
   43  general election.

   46  And the title is amended as follows:
   47         Delete line 10
   48  and insert:
   49         certain government bodies and to amend Section 5 of Article
   50  VI of the State Constitution to authorize all qualified
   51  electors, regardless of party affiliation, to vote in a partisan
   52  primary election for an office if all the candidates for the
   53  office have the same party affiliation and the winner will be
   54  opposed only by one or more write-in candidates in the general
   55  election.
